Elon Musk may add Twitter's whistleblower complaint to his counterclaim, the judge in the case ruled. At the same time, the date of the trial remained unchanged, despite the arguments of Musk's legal team.
A Delaware judge granted Elon Musk's request Wednesday to add whistleblower claims to his Twitter counterclaim. Musk’s legal team is permitted “incremental discovery relevant to the new allegations” raised by the whistleblower, Delaware Chancery Judge Kathaleen St. J. McCormick said in the ruling on Wednesday. A recently published complaint by fired security chief Peiter “Mudge” Zatko on Twitter confirms Musk's concerns about bot/fake accounts on the platform and further discredits the current CEO of the platform, Parag Agrawal.
“We are hopeful that winning the motion to amend takes us one step closer to the truth coming out in the courtroom,” said Alex Spiro, Musk’s lead lawyer.
However, Musk's team was unable to push back the hearing in the case to a later date, as ordered by the court. “I am convinced that even four weeks’ delay would risk further harm to Twitter too great to justify,” she wrote, maintaining the October 17 date, although Musk's lawyers have shown that Twitter transmits data—requested and approved by the Judge—with delays.
