Twitter Is Harassing David Sacks' Companies on Elon Musk's Platform Buyout Case

Twitter is harassing David Sacks’ companies in Elon Musk's platform buyout case, the entrepreneur said in a complaint to a Delaware judge. The social network has sent duplicate subpoenas to his companies from both Delaware and California, demanding a near immediate response on them.

David O. Sacks told a Delaware judge that Twitter was harassing his companies for information about Elon Musk's platform buyout case, according to BNN Bloomberg. The businessman told the judge that he had already complied with all of Twitter's demands, according to a court filing he filed on Thursday. Despite this, the platform continues to bombard his firms, Craft Ventures Management LP and Sacks.com LLC, with subpoenas in various states.

At the same time, Twitter is demanding nearly immediate responses, Sacks' lawyers said in a statement. “Further evidencing their harassing nature and intent, the Delaware subpoenas” demand a response within four days,” his attorneys said. This strategy is likely intended to turn Musk's friends, colleagues, investors, and supporters against him, which is manipulation with malicious intent.

According to Sachs' documents, Twitter sent duplicate subpoenas to his companies from both Delaware and California, where Twitter is based. According to his lawyers, this places an “unreasonable burden” on the firm in terms of defense costs.

“Because of Twitter's insistence on subpoenaing the exact same materials and deposits in both California and Delaware --and its refusal to withdraw the Delaware subpoenas -- Craft and Sacks.com have been forced to incur the duplicative expense of engaging counsel in two jurisdictions,” according to the filing.

Sacks has been personally subpoenaed in the Twitter case, but has not yet challenged those data demands in court. In his podcast, the entrepreneur said he had absolutely nothing to do with the deal and called the subpoenas “fishing expeditions.”
