Tesla May Use Words 'Autopilot' & 'Full Self-Driving' for Marketing in Germany, per Appeal Court Ruling

Justice has been served, along with a weighted decision by a German Intermediate Court of Appeals overturning a 2020 ruling from a Munich court. Tesla is free to use the words “Autopilot” and “Full Self-Driving” for marketing in the country.

In 2020, the automotive world was hit with the “big news” that has been on the front pages for some time: “German court rules that Tesla misled consumers on Autopilot and Full Self Driving” (CNBC's headline). The ruling decided that the manufacturer should be banned from using the words “Autopilot” and “Full Self-Driving” for advertising in Germany. Although the court's decision was controversial and reflected a superficial examination of the case, Tesla's rivals and the company's haters celebrated the victory. However, the Texas manufacturer did not stop seeking the truth and continued to fight, appealing the verdict.

The German blog, teslamag.dereported Sunday that the lawsuit against Tesla's advertisements for Autopilot and FSD has finally failed, based on documents obtained by the court. The publication reported that Tesla won the case. The Intermediate Court of Appeals ruled that Tesla could use the words “Autopilot” and “Full Self-Driving” for marketing in Germany and the decision is final and not subject to appeal. The decision was based on Tesla being very clear that Autopilot and FSD are driver assistance systems, not features that provide actual autonomous driving. At the same time, consumers who show interest in buying will find out about this during a more detailed study of information about the functions.
